Gandapur Restoration Petition Creates Political Stir

Gandapur Restoration Petition

The recent Gandapur restoration petition filed in the Federal Constitutional Court has once again brought political tensions in Khyber Pakhtunkhwa into the national spotlight. The petition, submitted by expelled PTI leader Sher Afzal Khan Marwat, seeks the reinstatement of former Khyber Pakhtunkhwa chief minister Ali Amin Gandapur.

The case has triggered intense political debate because it directly challenges the legitimacy of Gandapur’s resignation and the appointment of Sohail Afridi as the new chief minister.

According to the Gandapur restoration petition, Ali Amin Gandapur’s resignation was allegedly obtained under pressure and therefore lacks constitutional and legal validity. Sher Afzal Marwat argued before the court that the resignation should be declared null and void because it was not made freely and independently.

The controversy dates back to October last year when Gandapur stepped down from his position following directions reportedly issued by PTI founder Imran Khan. Shortly afterward, PTI Secretary General Salman Akram Raja confirmed Sohail Afridi’s nomination as the province’s new chief minister.

The Gandapur restoration petition has added another layer to the already complicated political situation surrounding Pakistan Tehreek-e-Insaf (PTI). Sher Afzal Marwat, who was expelled from the PTI over disciplinary issues, claimed that Gandapur’s resignation was sought under the influence of a “convicted disqualified individual,” a statement widely interpreted as a reference to Imran Khan.

Imran Khan has remained in jail since August 2023 and continues facing multiple legal cases ranging from corruption allegations to terrorism-related charges following his removal from office through a no-confidence motion in April 2022.

In the petition, Marwat requested the Federal Constitutional Court to declare Gandapur’s de-notification unconstitutional and restore him as chief minister of Khyber Pakhtunkhwa. He also asked the court to cancel the notification through which Sohail Afridi was appointed to the position.

The Gandapur restoration petition further demanded that all official decisions taken after Gandapur’s resignation should be reviewed and potentially nullified if the court finds the resignation unconstitutional.

However, Ali Amin Gandapur himself publicly distanced himself from the legal challenge. In his response, Gandapur stated that he had no involvement in the petition or any related judicial proceedings. He maintained that he had simply followed the instructions of PTI founder Imran Khan by resigning from the chief minister’s office.

This reaction created additional confusion because the petition was filed in support of Gandapur without his apparent direct backing. Political observers believe this contradiction may affect the legal and political strength of the case moving forward.

The debate surrounding the Gandapur restoration petition also exposed internal divisions and tensions within PTI and among former party members. While Sher Afzal Marwat insists the resignation was unconstitutional, senior PTI leaders strongly rejected his claims.

PTI Chairman Gohar Ali Khan criticized the petition and described it as part of a conspiracy against the party. According to Gohar, the PTI chairman alone has the authority to decide leadership matters within the province.

He further emphasized that Sohail Afridi’s appointment as chief minister was made with the consent of Imran Khan and therefore could not be challenged politically or constitutionally.

The Gandapur restoration petition has also raised broader constitutional questions regarding political party authority, resignations under party discipline, and the legal independence of elected representatives.

Legal experts note that courts may need to examine whether political pressure or party instructions can invalidate a resignation submitted by a sitting chief minister. The outcome could potentially influence future constitutional disputes involving party leadership decisions and elected officeholders.

Meanwhile, political analysts believe the case reflects ongoing instability within Pakistan’s political environment, particularly within PTI after the imprisonment of Imran Khan. Leadership disputes, internal disagreements, and legal battles continue shaping the country’s political landscape ahead of future elections.

The issue has attracted major public attention because Khyber Pakhtunkhwa remains one of PTI’s strongest political bases. Any uncertainty regarding provincial leadership could affect governance, party unity, and political strategy within the province.

The Gandapur restoration petition may also become significant because it tests the role of courts in resolving internal political conflicts. Whether the judiciary chooses to intervene deeply in the matter or dismiss the petition could carry important political consequences.

Sohail Afridi continues serving as chief minister while PTI leadership publicly supports his appointment. At the same time, the petition filed by Sher Afzal Marwat ensures that the controversy surrounding Gandapur’s resignation remains part of Pakistan’s ongoing political debate.

As legal proceedings move forward, the case is expected to remain closely watched by political parties, constitutional experts, and PTI supporters across the country.
