Election Commission Rejects PTI’s Requests to Delay Intra-Party Elections

The Election Commission of Pakistan (ECP) has rejected requests from the Pakistan Tehreek-e-Insaf (PTI) party regarding the delay of its intra-party elections. The decision was announced by a three-member bench comprising Nisar Durrani, Shah Mohammad Jatoi, and Justice Ikramullah, emphasizing the responsibility of political parties to conduct timely elections for their leadership.

PTI’s Request for Delay

PTI had requested that the Election Commission halt the intra-party election process until the Supreme Court issued a detailed verdict on specific seats. The party argued that delaying the elections was necessary to wait for clarity on legal matters related to the decision. However, the Election Commission highlighted that the party had already delayed the election process multiple times, and further postponement was unnecessary.

In its written decision, the ECP pointed out that PTI’s own internal delays and the complaints lodged by its members had prolonged the process. The commission stressed that the intra-party elections must take place as required by law, and the party was bound to adhere to the established timelines for electing officials at the federal, provincial, and local levels.

Importance of Intra-Party Elections

Intra-party elections are crucial for political parties in Pakistan to ensure democratic functioning and accountability within their ranks. These elections determine the office bearers and leadership who will represent the party at various levels. The Election Commission’s decision emphasized that it is the duty of registered political parties to elect their officials through a transparent process, in accordance with their constitutions and the law.

The Election Commission is also responsible for verifying the documentation and processes of intra-party elections to issue a certificate of compliance to the party. This certification confirms that the party has adhered to legal and constitutional requirements in conducting its internal elections.

Complaints from PTI Members

The Election Commission noted that it had received complaints from PTI’s own members regarding the intra-party election process. These complaints raised concerns about whether the elections were being conducted fairly and in line with the party’s constitution. The ECP, therefore, has the authority to ensure that the elections are conducted properly and to verify whether the party has fulfilled its legal obligations.

In the decision, the three-member bench stated that it is the ECP’s responsibility to examine whether the intra-party elections have been held according to the law. PTI’s requests for delaying the elections were thus rejected, as the Election Commission found no valid justification for halting the process.

Debate and Review Process

The Election Commission has set a date for further debates and review on PTI’s intra-party elections, scheduled for September 18. This hearing will provide an opportunity to address any remaining issues or concerns related to the party’s internal election process. The ECP will evaluate whether PTI’s elections were conducted in a transparent and lawful manner, ensuring that the party complies with all relevant regulations.

The ECP’s ruling also reaffirmed its commitment to upholding democratic principles within political parties, insisting that timely elections are essential to avoid unnecessary delays and political stagnation.

Return of Seized Documents and Equipment

Alongside its ruling on intra-party elections, the Election Commission also addressed PTI’s request to return certain documents and computers seized by the Federal Investigation Agency (FIA). These items had been confiscated as part of an investigation, and PTI had sought their return. However, the Election Commission clarified in its decision that the party should approach the relevant forum, such as the FIA, to address this issue.

The ECP stated that it does not have the authority to intervene in matters related to the return of seized items and advised PTI to follow the appropriate legal channels to resolve the matter.

The Election Commission’s decision to reject PTI’s request for delaying intra-party elections underscores the importance of adhering to legal timelines and processes. By ensuring that political parties conduct transparent elections for their leadership, the ECP aims to promote democratic values and accountability within Pakistan’s political system. PTI now faces the responsibility of proceeding with its intra-party elections, while the Election Commission continues to oversee and verify the process to ensure compliance with the law.
