Peshawar High Court Reserves Decision on PTI’s Intra-Party Elections and Electoral Symbol Case

The Peshawar High Court has reserved its decision on an appeal against the Election Commission’s scrutiny regarding Pakistan Tehreek-e-Insaf’s (PTI) intra-party elections and the matter of electoral symbols.

Justice Ejaz Khan of the Peshawar High Court is hearing the legal challenge initiated by PTI’s lawyers and senior advocate Justice Anwar Advocate in the courtroom.

During the proceedings, PTI’s lawyer Justice Anwar questioned whether the court could review the Election Commission’s decision. He expressed dissatisfaction with the Election Commission’s delay in implementing the verdict, which was issued on December 26. He highlighted that, to date, no action has been taken, and the Election Commission has not yet issued the intra-party election certificates on its website.

Justice Ejaz inquired whether there was any contempt of court case filed from their side. Justice Anwar responded, stating that their candidates’ nomination papers were rejected, and they sought to understand what actions the Election Commission had taken. He emphasized that the Election Commission should not favor one party over another, and it should conduct transparent elections.

The court preserved its decision on the Election Commission’s appeal after the arguments from both sides were completed.

It is noteworthy that the Election Commission had declared the intra-party elections of Pakistan Tehreek-e-Insaf against the constitution, subsequently nullifying PTI’s electoral symbol. However, PTI challenged the Commission’s decision in the Peshawar High Court.

The Peshawar High Court, while reserving its decision on PTI’s intra-party elections and electoral symbol case, has also invalidated the Election Commission’s decision to cancel PTI’s electoral symbol, subject to further proceedings.
